of Agape Web Hosting in any way, you are agreeing to be bound by our terms and conditions below.
If you are in disagreement with these terms, hosting with a different provider may best suit your needs.
Policy and Service Guidelines
We purpose to provide the highest quality of services to our customers and to do so, we have to set forth the following guidelines. The Registration Agreement (received
with commitment to services) also sets forth the terms and conditions for the use of
our services. This Agreement will become effective and enforceable when accepted
and agreed upon by both parties.
Content
All services provided by Agape
Web Hosting may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any United States, Federal, State, City, Country or Province law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless
Agape Web Hosting from any claims resulting from the use of the service which damages the subscriber or any other party.
Pornography and sex-related merchandising and material is prohibited on all sites hosted by
Agape Web Hosting. This includes sites that may infer sexual content,
abhorrent sexual preference, or links to adult content elsewhere.
Agape Web Hosting will be the sole arbiter in determining violations of this provision. If pornography is found on our server, the offending domain will be deleted immediately with no warning and no refunds of money will be given.
Also prohibited are sites that promote any illegal activity or present content that may be damaging to Agape Web Hosting servers or any other server on the internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:

Pirated software.

Hacker / Cracker programs or archives.

Warez sites.

Pornographic sites.

Promotion of racial discrimination or hatred.
Agape Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.
Your site cannot promote demonic, occult, satanic, new age or anti-Christian values or beliefs; cannot promote pro-choice or pro-abortion views; cannot promote gay or lesbian lifestyle views; cannot promote a distorted view or faulty interpretation of the Holy Bible (we are not talking about disputes between
KJV and NIV, we are talking of obvious misconstruing of God's Word such as saying that Jesus was not God).
Not only can you not have offending material on your sites, but you cannot have links to any sites with offending material on them or material listed above.
If links to any offending sites are found, we will ask you to remove them and if you do not comply, we will then have to remove your account from our server. The above listing is not complete by any means.
Agape Web Hosting will be the sole arbiter as to what constitutes a violation of this provision, and will inform all prospective customers BEFORE our services agreement is agreed upon and signed.
We reserve the right to refuse, cancel, or suspend services at our sole discretion.
E-mail
Spamming, or the sending of unsolicited e-mail or message board posts including, without limitation, commercial advertising and informational announcements, from our server(s) or using an e-mail address or domain that is maintained on an
Agape Web Hosting machine as reference in that spam is STRICTLY prohibited.
Domains and sites are subject to being canceled immediately off of our server for violation of spamming rules.
Media Streaming
In addition to web site and email hosting, Agape Web Hosting offers full-service audio and video streaming.
We
maintain dedicated Windows streaming servers for optimal media performance.
(Some Christian web hosts put streaming and web content on the same servers,
which can adversely affect performance). Our Streaming Server is
strictly dedicated to hosting and streaming your content.
For security and content management purposes, account holders are not authorized to upload content directly for streaming. Content can either be converted per your account settings at your point of upload for placement with our streaming services, or can be uploaded in "raw" format for conversion by our systems engineers, and then placed for streaming.
Content - Client agrees to take sole responsibility for all audio stream content (once loaded by our engineer), web pages, and any other service that is utilized. Agape Web Hosting is not liable for any action taken against a client as a result of their stream content or web content.
Content Restrictions -Agape Web Hosting will not actively monitor the content of client's broadcasts or website. Client will not, however, use server resources for any illegal activity, including the sharing of copyrighted programs as well as slanderous material.
Payment Terms
All hosting accounts are for a period of one calendar year from the date of ordering or renewal. Multi-year registration or renewal packages, accompanied by discounted rates are available upon request.

Fees are charged on an
annual pre-pay basis and are non-refundable.

Setup fees are non-refundable.
Billing will commence on the date of provisioning of disk space to customer web site regardless of domain name transfer / registration, customer site transfer, or configuration of web application by customer.
If you choose to be billed by credit card as opposed to a quarterly or monthly invoice, you agree to the following statements:

I authorize Agape Web Hosting to make periodic charges against my credit card account for the fees incurred in my using of their services as established by this order and subsequent additions to the level of service provided.

This authorization will remain in effect until Agape Web Hosting is notified 30 days in advance via postal or electronic mail that their services are no longer required.

I must provide Agape Web Hosting with the new expiration date on my credit card when one is issued.

If my account is over 14 days delinquent I understand that Agape Web Hosting may suspend my account until payment is received and that there is a $25 reactivation fee.

I understand there is a $25 returned check fee.
Updates -
Scheduled Maintenance and
Downtime
Agape Web
Hosting will use
its commercially reasonably efforts to provide services 24 hours a day, seven
days a week (server failover).
Subscriber acknowledges that from time to time the services may be inaccessible or inoperable for various reasons, including periodic maintenance procedures or upgrades ("Scheduled Downtime"); or service malfunctions, and causes beyond Agape Web Hosting control or which are not reasonably foreseeable by Agape Web Hosting, including the interruption or failure of telecommunications or digital transmission links, hostile network attacks, or network congestion or other failures.
Agape Web Hosting will provide at least 48 hours advance notice to the subscriber for Scheduled Downtimes, and will use commercially reasonable efforts to minimize any other disruption, inaccessibility and/or inoperability of its web servers.
Agape Web Hosting has no responsibility for downtime resulting from a user's actions.
